Mining Act

Duties of the Board under the Mining Act

It is the duty of the Board to hear and determine all questions, disagreements, matters or claims arising out of the application of the Mining Act and the regulations. Most disagreements will not reach the Board and are resolved between parties, or with the assistance of the Department of Natural Resources and Energy Development recorder. When disagreements cannot be resolved at that level, the issue is raised to the Board for review and a decision.

The Board normally conducts a hearing in a manner similar to the procedures of the courts, including such steps as what may or may not be entered into evidence and issuing summonses for witnesses. When disputes go before the Board, typically both sides in the dispute are represented by lawyers.

How to File an Appeal to the Board

To file an application or appeal to the Board under the Mining Act and the regulations, please send written correspondence to general@nbeub.ca setting out the following information:

(a) the name and full contact information of all of the parties involved in the dispute;
(b) the nature of the dispute;
(c) the grounds for the appeal or application; and
(d) confirm the applicant's desire for the Mining Commissioner to commence a hearing into the matter.
